These Terms of Service ("Terms") constitute a legally binding agreement between you and MomentCast ("MomentCast," "we," "us," or "our") governing your access to and use of the MomentCast platform, including our marketing site at momentcast.live, our streamer dashboard at app.momentcast.live, and all related services.
By creating an account, purchasing credits, or using any part of the platform, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
If you do not agree to these Terms, do not use MomentCast.

You must be at least 18 years old and have the legal capacity to enter into a binding agreement to create a Streamer account. MomentCast is intended for professional use by photographers, videographers, and event service providers.
Each individual or business entity may maintain only one Streamer account. We reserve the right to merge or terminate duplicate accounts.

MomentCast operates on a credit-based system. Each credit entitles you to create one event with a set allocation of viewing hours. You may add additional viewing hours to an active event by applying more credits from your balance at any time.
Credits are available for purchase through the Streamer dashboard. All payments are processed securely by Stripe. MomentCast does not store your credit card number, CVV, or other raw payment data. All prices are listed in U.S. dollars (USD).
Credits may be offered individually or in discounted multi-credit packs. Specific pricing, pack sizes, and any promotional discounts are displayed at the time of purchase in the dashboard and are subject to change. Any price change applies only to future purchases and does not affect credits already purchased.
Prices displayed may not include applicable sales tax, VAT, or other local taxes. You are responsible for any taxes associated with your purchases. Tax will be calculated and displayed, where applicable, at checkout.

Summary: Credits applied to events are fully refundable if the event is cancelled before streaming begins. Once streaming credentials have been activated, credits applied to that event are non-refundable.
If you cancel an event before revealing or using your streaming credentials, all credits applied to that event (including any additional viewing hours purchased) will be returned to your account balance in full. This applies regardless of how many credits were applied.
Once streaming credentials have been revealed or the stream has gone live, the credits applied to that event are considered consumed and are non-refundable. This includes the initial credit used to create the event and any additional credits applied for extra viewing hours.
Viewing hours that are allocated to an event but not consumed by viewers are not refundable and do not roll over to other events. We encourage Streamers to start with the default allocation and add viewing hours only as needed during the event.
Credits sitting in your account balance that have not been applied to any event may be eligible for a refund at our discretion. To request a refund of unused credits, contact support@momentcast.live. Refunds of unused credits will be processed to the original payment method via Stripe.
If you believe a charge was made in error, contact us at support@momentcast.live within 30 days of the transaction. We will review and resolve the matter within 10 business days.

We reserve the right to suspend or terminate any account that violates these rules, with or without notice, and without refund of credits.

You retain full ownership of all content you stream, upload, or create through MomentCast, including video streams, recordings, logos, cover photos, and event metadata ("Your Content"). MomentCast does not claim ownership of Your Content.
By using MomentCast, you grant us a limited, non-exclusive, worldwide, royalty-free license to host, store, transmit, and display Your Content solely for the purpose of providing the Platform's services to you and your viewers. This license terminates when your Your Content gets auto-deleted or close your account.
All aspects of the MomentCast Platform, including its design, code, branding, logos, and documentation, are the intellectual property of MomentCast and are protected by applicable copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the Platform.
If you provide suggestions, ideas, or feedback about MomentCast, we may use them without obligation or compensation to you.

We strive to maintain high availability for all MomentCast services. However, we do not guarantee uninterrupted, error-free, or continuously available service. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Each credit includes a defined allocation of viewing hours. When an event's cumulative viewing hours reach the allocated limit, new viewers may not be able to join the stream. Existing viewers already watching will not be disconnected. Streamers can add more viewing hours at any time by applying additional credits from their account balance.
Live stream recordings are generated automatically after a stream ends. Recordings are subject to retention periods as described in our Privacy Policy. We are not responsible for recordings that fail due to network interruptions, encoding errors, or other technical issues beyond our control.
MomentCast relies on third-party services for video delivery, payment processing, and infrastructure. We are not liable for outages, failures, or changes to these third-party services that may affect the availability or performance of the Platform.

To the maximum extent permitted by applicable law:
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for certain damages. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

You agree to indemnify, defend, and hold harmless MomentCast, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or related to:

You may close your account at any time by contacting support@momentcast.live. Upon account closure, any unused credits in your balance that have not been applied to events may be eligible for a refund at our discretion (see Section 5). Credits applied to active or completed events are non-refundable.
We may suspend or terminate your account at any time if:
If we terminate your account for a reason other than a Terms violation, we will refund any unused, unapplied credits to your original payment method.
Upon termination, your right to access the Platform ceases immediately. We may delete your account data in accordance with our Privacy Policy. Sections 8, 10, 11, and 13 of these Terms survive termination.

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.
Any dispute arising from or relating to these Terms or your use of MomentCast shall first be attempted to be resolved through informal negotiation by contacting support@momentcast.live. If the dispute cannot be resolved within 30 days, either party may pursue binding arbitration in Orange County, California, under the rules of the American Arbitration Association.
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against MomentCast.
Notwithstanding the above, either party may bring an individual action in small claims court in Orange County, California, provided the claim falls within the court's jurisdictional limits.

We may update these Terms from time to time. When we make material changes, we will notify registered Streamers by email and update the "Last Updated" date at the top of this page.
Your continued use of MomentCast after a Terms update constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and may request account closure.
Non-material changes (such as formatting corrections or clarifications that do not alter your rights or obligations) may be made without notice.
